Bonus Payments

Generally, a bonus will become due if:

  1. If it’s purpose was to increase an employee’s productivity.
  2. The bonus was announced to the employee prior to the beginning of the work.

On the other hand, where the bonus pay is considered a gift or for past services or work, the bonus generally, need not be paid out.

If the bonus must be paid out, it will become part of the employee’s wages for the purpose of calculating overtime.
